This privacy policy (“Privacy Policy”) governs how we, Groundcover Ltd. and our affiliates (together, “Groundcover” “we”, “our” or “us”) use, collect, and store Personal Data we collect or receive from or about you (“you”).
Please read this Privacy Policy carefully, so you can understand our practices and your rights in relation to Personal Data. “Personal Data” or “Personal Information” means any information that can be used, alone or together with other data, to uniquely identify any living human being and any information deemed as Personally Identifiable Information by privacy laws. This Privacy Policy can be updated from time to time and, therefore, we ask you to check back periodically for the latest version of this Privacy Policy. 1.1.1 Personal Data we collect: We use analytics tools, cookies and log files on our Website which collect Personal Data such as IP address, pages clicked, search and browser history, and device information, session durations, user pattern of your use of the Website, the frequency and scope of use of the Website and information about computers and internet connection, including the operating system used and browser type.

1.2.4 Consequences of not providing the Personal Data: We cannot: receive and answer your request to book a demo; provide further information to the extent requested; respond to your questions, comments, and other requests for ongoing customer assistance, technical support and maintenance of the Website or send you demo-related communications; better understand your needs, both on an aggregated and individualized basis; communicate with you and contact you to obtain feedback from you regarding the Website and product offering; and/or establish a business relationship with you. In addition, we won’t be able to send you marketing communications (subject to your consent).

1.3.2 For what purposes: To subscribe you to our blog or newsletter and send you updates about Groundcover, including marketing communications, to understand your needs and interests, optimize the content we send you and make it more suitable and relevant to your needs, including, to improve your experience on the Services (as defined below) by providing you with personalized content, recommendations, and features. For the purposes of this Privacy Policy, “Services” shall refer to all product(s), service(s) or offering(s) made available by Groundcover, including the Platform (as defined below).
1.3.3 Legal basis (GDPR only, if applicable): Depending on the context, legitimate interest or consent.
1.3.4 Consequences of not providing the Personal Data: We will not be able to provide you with updates or send you marketing communications.
1.4.1 Personal Data we collect: Full name, email address, phone number, CV/cover letter and any other information that you decide to provide us with.
1.4.2 For what purposes: To process your job application, to assess you as a candidate and to send you candidate-related communications.
1.4.3 Legal basis (GDPR only, if applicable): Performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract and/or legitimate interest (to assess you as a candidate when you submit the data voluntarily to us).
1.4.4 Consequences of not providing the Personal Data: We will not be able to assess you as a candidate.
1.5.1 Personal Data we collect: Full name, organization you are attributed to and the location of the computer through which you used the Services, as well as log in details (name, email address, username, password). We may also automatically collect certain information about how you use and interact with our Platform’s features (e.g., the pages you visit, the buttons or links you click, the amount of time spent on particular screens or features, usage frequency, errors encountered, and other relevant user behavior data.
1.5.2 For what purposes: To allow you to register for and log-in to Groundcover’s platform (“Platform”) (including, to verify and authenticate your identity and prevent unauthorized or illegal activity); to provide you with the Services and perform the relevant agreement with our customers; for monitoring and security purposes, including for user authentication, logging and debugging; to provide support (e.g., ticketing and chat functions); to improve our Platform’s services; to allow you to send us feedback; to conduct surveys and research, test features in development, and analyze the information we have to evaluate and improve our Services, develop new features, and conduct audits and troubleshooting activities; to customize your experience in our Platform; to improve the management and administration of our business and maintain compliancy with our internal policies and procedures, and to send you marketing communications via email.
1.5.3 Legal basis (GDPR only, if applicable): Performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract and/or legitimate interest (e.g., to allow you to create an account in our Platform) or consent (for marketing, if required under applicable law).
1.5.4 Consequences of not providing the Personal Data: We cannot allow you to register for and log-in to our Platform and/or provide you with the Services and perform the relevant agreement with our customers. We may also have limited ability to improve or customize your experience and certain product features, optimizations, or insights, may not be available or as effective without this information.
1.6.1 Personal Data we collect: Full name, company name, position, and title, email address, and other information provided by you when you interact with us.
1.6.2 For what purposes: To establish a business connection and/or communicate with you, and to send you marketing communications.
1.6.3 Legal basis (GDPR only, if applicable): Depending on the context, legitimate interest or consent (e.g., marketing communications).
1.6.4 Consequences of not providing the Personal Data: We will not be able to respond to your requests, establish and business relationship and send you marketing communications.

Please note that some of the above-mentioned Personal Data will be used for detecting, taking steps to prevent, and prosecution of fraud or other illegal activity, to identify and repair errors, to conduct audits, and for security purposes. Personal Data may also be used to comply with applicable laws, with investigations performed by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims. In certain cases, we may or will anonymize or de-identify your Personal Data and further use it for internal and external purposes, including, without limitation, to improve the Services and for research purposes. We may use information which does not enable identification of an individual user, such as aggregated information about the use of our Services and/or disclose it to third parties without restrictions (for example, in order to improve our Services and enhance your experience with them).
2.1 Security. We have implemented appropriate technical, organizational and security measures designed to protect your Personal Data. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.
2.2 Retention of your Personal Data. We retain your Personal Data as follows: (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings.
3.1 We may share your Personal Data with our business partners with whom we jointly offer products or services. We may also share Personal Data with our affiliated companies. They may combine this Personal Data with other details they hold about you. Unless they provide you with their own privacy policy, they may use your Personal Data for the purposes explained in this Privacy Policy. We are part of the Groundcover group, which is a global organization. For the purposes explained in this Privacy Policy, we may transfer your Personal Data to Groundcover group companies (including service providers operating on their behalf) and other third parties in countries which do not have the same level of data protection laws as those in the country where you are located. Groundcover uses several legal mechanisms, including EU Standard Contractual Clauses, to help ensure that your rights and protections are respected by all companies of the Groundcover group. We use efforts to ensure that each Groundcover group company will comply with the key data protection principles of fair handling of Personal Data and ensuring adequate level of protection of Personal Data.
3.2 We may use third party service providers to process your information, including Personal Data, for the purposes outlined above, including, without limitation:
3.2.1 with cloud service providers for hosting purposes;
3.2.2 with websites and web content creation platforms in order to help us manage our Website;
3.2.3 with email providers, marketing, CRM, other similar tool providers; and
3.2.4 with analytic companies, in order to help us understand and analyze information we collect in accordance with this Privacy Policy.
3.3 To the extent necessary, we may share your Personal Data with regulators, courts, banks, or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order.
3.4 If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we reserve the right to transfer, disclose, or assign your Personal Data to such third party (whether actual or potential) in connection with the foregoing events.
3.5 In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Personal Data in connection with the foregoing events, including, in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company.
3.6 We may share your Personal Data where you have provided your consent to us sharing or transferring your Personal Data (e.g., where you provide us with marketing consents or opt-in to optional additional services or functionality).

4.1 The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by specific laws):
4.1.1 You have the right to withdraw consent to the processing, where consent is the basis of processing.
4.1.2 You have the right to access the personal information that we hold and request further details about how we process it, under certain conditions.
4.1.3 You have the right to demand rectification of inaccurate personal information about you. We will promptly correct any information found to be incorrect.
4.1.4 You have the right to object to unlawful data processing under certain conditions.
4.1.5 You have the right to the erasure of past data about you (your “right to be forgotten”) under certain conditions.
4.1.6 You have the right to demand that we restrict the processing of your personal information, under certain conditions, if you believe we have exceeded the legitimate basis for processing, the processing is no longer necessary, or if you believe your personal information is inaccurate.
4.1.7 You have the right to data portability of personal information concerning you that you provided us in a structured, commonly used, and machine-readable format, subject to certain conditions.
4.2 The personal information we collect is not used for automated decision-making and profiling, except for automated processes in the context of marketing.
4.3 You can exercise your rights by contacting us at privacy@groundcover.com. You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfill your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.
4.4 Deleting your account: Should you ever decide to delete your account, you may do so by emailing privacy@groundcover.com. If you terminate your account, any association between your account and personal data we store will no longer be accessible through your account. However, given the nature of sharing on certain services, any public activity on your account prior to deletion will remain stored on our servers and will remain accessible to the public.
4.5 Marketing emails – opt-out: You may choose not to receive marketing emails by sending a single email with the subject “BLOCK” to privacy@groundcover.com. Please note that the email must come from the email account you wish to block OR if you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails, and we will process your request within a reasonable time after receipt.
5.1 We store the Personal Data with the following storing companies: Amazon Web Services (US).
5.2 External transfers: Where we transfer your Personal Data outside of EU/EEA (for example to third parties who provide us with services), we will generally obtain contractual commitments from them to protect your Personal Data. When Groundcover engages in such transfers of personal information, it relies on (i) Adequacy Decisions as adopted by European Commission on the basis of Article 45 of Regulation (EU) 2016/679 (GDPR) (for example, when we access from Israel), (ii) Standard Contractual Clauses issued by the European Commission, or (iii) the recipient’s certification to the EU-US Data Privacy Framework. Groundcover also continually monitors the circumstances surrounding such transfers in order to ensure that these maintain, in practice, a level of protection that is essentially equivalent to the one guaranteed by the GDPR.
5.3 In order to run our business and provide our Website and Services to you, we transfer Personal Data to certain countries around the world, including to our affiliates and service providers, many of whom are located outside of your jurisdiction. Therefore, your Personal Data may be processed in countries with privacy laws that are different from privacy laws in your country. Whenever we make such transfers, we will use commercially reasonable efforts to implement an appropriate level of protection to your Personal Data by implementing at least one of the following safeguards:
5.3.1 making sure the destination country has been deemed to provide an adequate level of protection for Personal Data; and/or
5.3.2 executing implement data onward transfer instruments such as data processing and protection agreements.
We do not offer our products or services for use by children and, therefore, we do not knowingly collect Personal Data from, and/or about children under the age of eighteen (18). In the event that we become aware that you provide Personal Data in violation of applicable privacy laws, we reserve the right to delete it. We enable you to interact with third party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect Personal Data from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service.
We use log files. We use such information to analyze trends, administer the Website, track users’ movement around the Website, and gather demographic information.
Our Services may utilize “cookies”, anonymous identifiers and other tracking technologies for us to provide our Services and present you with information that is customized for you. A “cookie” is a small text file that may be used, for example, to collect information about activity on the Services. We do not combine the information collected through the use of Google Analytics with Personal Information we collect. The Platform uses FullStory in order to better understand our users’ needs and to optimize the Service and experience. FullStory is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. FullStory uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device’s IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. FullStory stores this information in a pseudonymized user profile. FullStory is contractually forbidden to sell any of the data collected on our behalf. The Website uses a tool called “Google Signals” to collect information about use of the Website. When we activate Google Signals, some existing Google Analytics features are updated to also include aggregated data from Google users who have turned on “Ads Personalization” (Ads Personalization available at https://support.google.com/ads/answer/2662856/). Audiences that we create in Google Analytics and publish to Google Ads and other Google Marketing Platform advertising products can serve ads in cross device-eligible remarketing campaigns to Google users who have turned on Ads Personalization. Google Analytics collects additional information about users who have turned on Ads Personalization, base across device types and on aggregated data from users who have turned on Ads Personalization. The data is user based rather than session based. The Cross Device reports include only aggregated data. No data for individual users is ever exposed. You can modify your interests, choose whether your Personal Data is used to make ads more relevant to you, and turn on or off certain advertising services in the Ads Personalization link above.

Website Visitors – individuals who visit our website, https://www.groundcover.com/ ("Website") and who may volunteer certain contact data (such as their email address and any other Personal Information you may choose to provide us) to receive communications from Groundcover or to schedule a conversation with our team (defined below).

Customers – those who register on their own or on behalf of an entity or organization to use any product(s) or service(s) within Groundcover’s platform("Platform"), including administrators of an account with Groundcover account, we collect log in details, such as name and email address. For the purposes of this Privacy Policy, “Services” shall refer to all product(s), service(s) or offering(s) made available by Groundcover.

End Users – individuals who visit our customers’ websites and whose information we process (on behalf of our customers) in order to provide the Services to our Customers pursuant to our agreements with them (“End Users”). All Personal Data about End Users will be solely collected on behalf of our customers. Groundcover may use the data collected for analytics and customization of ads only in an aggregated and anonymized form. Groundcover will not collect or process any Sensitive Data of End Users.
Depending on which features of the Platform you use, we collect different kinds of information (including Personal Information) about or from you. This Personal Information is necessary for the performance of our contractual obligations towards you and providing you with our Services, to protect our legitimate interests, as well as for compliance with regulatory obligations to which we are subject. In addition, we collect Personal Data to answer your questions, to allow you to sign-up to use the product or contact our team via the Website and to provide support and in some cases, to add you to our mailing list and to send you newsletters and other marketing communications. If this information will not be provided, you may not be able to use our Platform (such as opening a Groundcover Account), or certain features of our Platform. In certain instances, we will obtain your consent to the collection of your Personal Information, as appropriate (in which case, you can revoke your consent at any time by approaching us).
